THE last few years have witnessed a quiet explosion in the scope and pervasiveness of federal regulation. Beyond a small group of experts and practitioners, however, little notice has been taken, even though this constitutes a significant change in the relationship between the federal government and the private sector, with highly significant economic and political implications.
