NOTWITHSTANDING its somber subject matter, Stuart  Banner’s The Death Penalty: An American History † is a joy to read. Besides being lucid and informative, Banner is almost preternaturally even handed in his presentation of the arguments that have been offered for and against the death penalty. Despite the book’s many virtues, however, it is unlikely to offer a significant contribution to our contemporary policy debates.
